CHAPTER 4 REGISTERED LAND

As from November 2008 the Land Registry have issued new forms which will require proof of identity of the parties involved in a transaction where the value of the land is more than £5,000. If any of the parties are unrepresented by a solicitor, licensed conveyancer, etc, additional forms will have to be filled in. The purpose of this is to cut down on identity fraud.

Events which trigger the first registration of land that was previously unregistered land (page 54)

From April 2009 two new triggers have been added by the Land Registration Act 2002 (Amendment) Order 2008. The first is when a new trustee is appointed of unregistered land held in trust and where the land vests in the new trustee by deed or by a vesting order. The second is when unregistered land held in trust is partitioned (page 207). According to the Land Registry:

    ‘This would make a significant contribution towards achieving the comprehensive register, by bringing nearly a million hectares onto the register within 5 years that would not have been otherwise. For a comparison the counties of Devon and Cornwall combined amount to 1.027 million hectares.
